Uhura Terms and Conditions

Introduction

The purchase of any travel services offered by Uhura Travel authorized to do business as Uhura (hereinafter “Uhura”) constitutes a contractual arrangement between the local or foreign tourist (“the Tourist”) and Uhura, and represents your acceptance of the Uhura Terms & Conditions set out herein.

Please ensure that you carefully read and understand these Terms & Conditions prior to making your booking. You are advised to check on our website or to request the latest version of the Terms & Conditions from Uhura prior to booking your vacation/tour.

The Tourist must at all times comply with all South African laws, customs, foreign exchange regulations and any other regulations applicable. The Tourist must strictly abide to the following rules during the Uhura tours:

  • No alcohol, drugs or any other intoxicating substances of any nature whatsoever are permitted on our tours;
  • Any disruptive, dangerous or potentially dangerous behavior during the tour shall not be tolerated and that Uhura reserves the right to exclude the Tourist from the rest of the tour at any point wherein such circumstances arise. (Uhura shall not be held liable for any costs and or/expenses incurred for by the Tourist as a result of the Tourist being excluded as aforesaid, and the Tourist shall not be entitled to a refund or rebate of the tour price or and additional compensation in such instances).

Tour Price and Payment

  • The tour price is as stipulated on the invoice provided to you by Uhura (“Tour Price”).
  • Full payment of the Tour Price is due 30 days prior to the tour (except day tours booked while the tourist is already in South Africa). Your booking will be automatically cancelled if the full payment or the balance thereof is not received as aforementioned.
  • Uhura is not responsible for cancelled land and/or air reservations (or any other costs and expenses incurred by the Tourist) in the event payment is not received by the final payment date as aforementioned.
  • The Tour Price includes all services, meals that are included as per the itinerary.
  • The Tour Price is in South African currency being ZAR. If payment is in any other currency the amount paid in a foreign currency should be equal to the Tour Price after currency conversions have occurred. Proof of payment of the Tour Price must be emailed to bookings@uhuratravel.co.za. Uhura will confirm the booking via email once the full payment has been received.

Cancellation Policy

  • All cancellations must be made in writing to Uhura immediately after such decision has been reached.
  • No cancellation fee is applicable to tours cancelled more than 60 (sixty) days prior to the tour date.
  • Should the Tourist cancel a booking within 60 (sixty) days or less prior to tour date for any reason (except hospitalization), the Tourist will be liable to pay cancellation fees as follows:
    • 60+ Days: No cancellation fee will be applicable
    • 30-60 Days: 50% of the full Tour Price as the cancellation fee will be applicable
    • 15-29 Days: 75% of the full Tour Price as the cancellation fee will be applicable
    • 0-14 Days: 100% of the full Tour Price as the cancellation fee will be applicable
  • Uhura reserves the right, at any time and for any reason it deems reasonable, to cancel the tour on notice to the Tourist. In such event Uhura will refund all funds paid by the Tourist. The tours are subject to a minimum of 2 people. If the Tourist does not complete the tour with the rest of the group, for any reason whatsoever, he or she shall not be entitled to any refunds whatsoever.

Passports, Visas and other Travel Papers

It is the responsibility of the Tourist to ensure that passports, visas, health certificates, proof of vaccinations and any other required documentation are all in order before the tour date.

Insurance

  • It is the Tourist’s responsibility to have travel insurance and present it before travelling on our tours.
  • Should the Tourist not supply Uhura with travel insurance papers prior to the tour, the Tourist may be excluded from travelling and he/she will be liable for cancellation fees, costs and expenses incurred as a result thereof.
  • Travel insurance must include comprehensive medical insurance and Uhura shall not be liable for any consequences, damages or loss as a result of the Tourist failing to have the necessary cover.

Baggage/Luggage

  • The Tourist shall be responsible for his/her baggage or luggage and personal items on tour. Uhura will not be liable for any loss or damage to such baggage/luggage or personal items, howsoever arising

Sharing of rooms

  • It is the responsibility of Tourist to provide Uhura with a rooming list prior to the start of the tour.

Health

  • The Tourist hereby irrevocably accepts to participate in a test of physical fitness and health to measure the Tourist’s physical fitness and health.
  • The Tourist is obliged to ensure that he/she is medically fit to embark on the tour.
  • Uhura will not be held liable for any medical costs or expenses (direct, indirect or consequential) that might be incurred by the Tourist during the tour due to the Tourist’s health and physical fitness not being on a standard required for the tour.

Unforeseen circumstances

  • Unforeseen circumstances including mechanical breakdowns, weather, riots and other events of force majeure, which are beyond the control of Uhura may cause delays or alterations to the tour and/or the tour schedule.
  • Uhura shall not be liable (directly or indirectly) in any way for any of these possible occurrences or any consequences, which may arise as a result thereof.

Indemnification and exclusion of liability

  • The Tourist accepts that the tour is of an adventurous nature and involves an element of personal risk.
  • Uhura and its representatives and agents shall not be liable for any loss or damage of whatsoever nature and howsoever arising (including, but not limited to, the Tourists or any other persons injury or death, or any loss or damage to the Tourist’s or any other person’s property) which the Tourist or any such other person may incur or suffer as a result of or arising from the Tourist’s participation in the tour and any other activities undertaken on or during the tour, and the Tourist hereby irrevocably and forever releases and discharges Uhura and its representatives and agents from any and all such liability.
  • The Tourist furthermore indemnifies and holds Uhura and its representatives and agents harmless from and against any and all loss, damage, actions, proceedings, claims, demands and legal and any other costs and expenses (including legal costs on an attorney and client costs) of whatsoever nature and howsoever arising (including, but not limited to, the Tourist’s or any other persons injury or death, or any loss of or damage to the Tourist’s property) which the Tourist or any other such person may incur or suffer as a result of or arising from the Tourist’s participation in the tour and any other activities undertaken on or during the tour.
